Welcome to Digital Data Lab. These Terms and Conditions govern your use of our website (https://digitaldatalab.in) and the data recovery services provided by our laboratory in Chhatrapati Sambhajinagar, Maharashtra.
By submitting a device for evaluation or engaging our services, you (the “Client”) agree to the following terms.
1. Authorization and Ownership
- Legal Rights: By sending or handing over media (Hard Drives, SSDs, Servers, Flash Drives, etc.) to Digital Data Lab, the Client states that they are the legal owner of the device and the data contained within it, or that they have explicit authorization from the legal owner to request data recovery services.
- Right to Refuse: Digital Data Lab reserves the right to refuse service to anyone if we suspect the media is stolen or contains illegal material.
2. Evaluation and Service Execution
- Free Initial Diagnosis: We offer a free initial evaluation to determine the extent of the damage and the possibility of recovery.
- No Guarantee of Recovery: While our engineers use the world’s best tools and methodologies, data recovery is a complex process. The Client acknowledges that data recovery cannot be 100% guaranteed. Devices may be severely degraded or suffer from platter damage that renders data unrecoverable.
- Inherent Risks: The Client understands that storage media that has suffered physical or logical damage is already in an unstable condition. Digital Data Lab shall not be held liable if the condition of the media degrades further during the evaluation or recovery process.
3. Quotation and Payment
- Approval of Quote: After evaluation, we will provide a firm quotation for the recovery. No actual recovery work will proceed without the Client’s written or verbal approval of the quote.
- No Data, No Charge Policy: If we are completely unable to recover any of the agreed-upon critical data, the Client will not be charged the recovery fee (diagnostic or shipping fees may still apply, if agreed upon in advance).
- Payment Terms: Full payment is required before the recovered data is handed over or shipped back to the Client. We accept bank transfers, UPI, and major credit/debit cards.
4. Delivery of Recovered Data
- Transfer Media: Recovered data will be transferred to a new, healthy storage drive. The Client can either purchase a new drive from Digital Data Lab or provide their own blank drive with sufficient capacity.
- Verification: The Client has the right to verify the recovered data remotely (via a secure session or file list) before making the final payment.
- Data Retention: As stated in our Privacy Policy, a secure backup of the recovered data is kept on our offline servers for 7 to 14 days to ensure safe transit. After this period, the data is permanently wiped from our systems.
5. Unclaimed Devices and Media
- Any storage media (original damaged drives or return drives) left at Digital Data Lab for more than 60 days without communication, payment, or pickup instructions will be considered legally abandoned.
- Digital Data Lab reserves the right to securely wipe and dispose of, or recycle, abandoned media. We will not be held responsible for any loss of data or hardware after this 60-day period.
6. Confidentiality
Digital Data Lab treats all recovered data with the highest level of strict confidentiality. We do not inspect the contents of your files unless specifically required to verify file integrity. We will never share, sell, or disclose your personal or business data to any third party. For more details, please review our Privacy Policy.
7. Limitation of Liability
- Digital Data Lab, its employees, and directors shall not be held liable for any direct or indirect damages, loss of profits, loss of business, or loss of confidential information arising out of the data loss incident itself or the recovery process.
- Our maximum liability to the Client, for any claim related to our services, shall not exceed the total amount paid by the Client for the specific data recovery service.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms or our services shall be subject to the exclusive jurisdiction of the courts in Chhatrapati Sambhajinagar, Maharashtra, India.
